# Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE SERVICE
• SECURITY OF YOUR DATA
• RESULTS FROM USE OF THE SERVICE

## 2. Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY:
• Indirect, incidental, or consequential damages
• Special or punitive damages
• Lost profits or revenue
• Lost data or business interruption
• Damages from reliance on the Service
• Damages from AI outputs or recommendations

REGARDLESS OF:
• Theory of liability (contract, tort, strict liability)
• Whether we were advised of possibility of damages
• Whether damages were foreseeable

## 3. Maximum Liability

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED:

The greater of:
• The amount you paid us in the 12 months preceding the claim, OR
• Fifty US Dollars ($50.00)

This limitation applies to all claims in aggregate, not per incident.

## 4. Exceptions

These limitations do NOT apply to:

• Our gross negligence or willful misconduct
• Fraud or intentional misrepresentation
• Liability that cannot be excluded by law
• Your indemnification obligations

Some jurisdictions do not allow certain limitations, so some may not apply to you.

## 5. Essential Purpose

You acknowledge that:

• These limitations are fundamental to the agreement
• We would not provide the Service without these limitations
• The limitations allocate risk between the parties
• Pricing reflects these risk allocations

The limitations shall apply even if remedies fail of their essential purpose.

## 6. Third-Party Services

We are NOT liable for:

• Actions or failures of third-party services
• AI model outputs or recommendations
• Third-party content accessed through the Service
• Payment processor errors or fraud
• Internet connectivity or infrastructure issues

You use third-party services at your own risk.
